Fosseway Fridge Hire Terms and Conditions

Definitions 

"We/Us" means Jack Oughton, t/a Fosseway Fridge Hire

"You" means the Customer whose details are on the Booking Form

“Unit” means any equipment hired from Us.

“Site” means the event address stipulated in the Booking Form.

For "Price", "Event", and "Deposit" see the Booking Form.

1. Agreement and Acceptance of Terms:

By using the mobile fridge hire services provided by Us, You agree to abide by these terms and conditions. These terms constitute a legally binding agreement between the You and Us.

2. Booking and Reservation:

a. To book a Unit, customers must provide accurate information requested on the Booking Form, including event dates, delivery location, and contact details.

b. A deposit of £50 must be paid to secure the booking unless an alternative deposit figure is agreed.

c. Full payment must be received seven days prior to delivery, failure to make payment by this date forfeits your booking and the deposit will not be returned.

3. Delivery and Collection:

a. We will deliver and collect the Unit at the specified location and time agreed upon during the booking. This includes setting up and disconnecting the Unit.

b. You must ensure access to the delivery and collection location and provide necessary permissions if required.

c. You will provide a firm and level site of turf or hard standing with access and hard-standing for commercial vehicles.

d. You will provide at least 3kw of power via either a 13 AMP 3-pin socket or a 16 AMP C-form socket.

4. Hire Period:

a. The hire period begins on the agreed delivery date and ends on the collection date. Responsibility for the unit falls to you from the point we unhook the Unit from the delivery vehicle to the point we hook it up to be removed.

b. Any extension of the hire period must be communicated and approved in advance.

c. If we are unable to remove the Unit, you will incur hire charges at the daily rate until we can, which You must pay within 7 days of notification.

5. Care of Equipment:

a. You are responsible for identifying and notifying us of any damage to the trailer at the start of the hire period that may reflect as damage caused during the hire period.

b. Any new damages incurred during the hire period will be billed for at cost. For hires where a damage deposit has been paid, damages will be billed for at “cost” if beyond the value of the damage deposit amount already paid. All damaged deposits will be refundable upon inspection of the “equipment” after the hire period.

c. You are responsible for the proper care and safe use of the Unit during the rental period. This includes reimbursing us for any loss or damage to the Unit, unless caused by Us.

d. You will ensure the trailer is insured against theft and damages during the Hire Period.

e. You will report any damage or loss to us promptly and if caused by a suspected crime also report to the Police and obtain a crime reference number which you will share with Us.

f. Excessive cleaning will be charged for at cost and You will be notified of this on or within 24 hours of collection of the Unit.

 6. Fees and Payments:

a. The customer agrees to pay the rental fee as specified in the Booking Form.

b. Additional charges may apply for late returns, damage, excessive cleaning, or other breaches of the terms.

7. Cancellation:

a. We reserve the right to apply cancellation fees if You cancel the booking within a specified period. Once the deposit is paid this is non-refundable.

  • If You cancel more than 90 days prior to the event a full refund - less the deposit - will be issued.

  • If You cancel within 90 days of the event we will refund you 50% of the hire fee excluding the deposit.

  • If You cancel within 7 days of the Event you will be liable for 100% of the booking fee and no refunds will be issued.

We advise you take out insurance cover against cancellation.

b. We reserve the right to cancel the booking and a full refund. We will use our best endeavours to supply you with the Unit ordered but where this is not possible we will notify you as soon as possible of any alteration. You are not entitled to cancel if the alteration is necessary to comply with safety or other legal requirements, or does not materially affect what we will supply. If the alteration for any other reason and fundamentally different from the Unit on the Booking Form you may terminate this contract and any Deposit paid will be refunded.

8. Variations

a. If You want to change anything from the details shown on the Booking Form you must let us know in advance. If We can provide what you have requested we will provide a cost for you to confirm acceptance of. We are not obliged to agree any variation. Any variation will be subject to these Terms & Conditions.

b. If you do not comply with these Terms and Conditions We shall be entitled to add to the booking fee a reasonable figure for additional costs which we incur as a consequence.

9. Liability:

a. We will take all reasonable care during installation and removal of the Unit, to avoid damage to Your property. The Price does not include making good or repairs to the Site unless caused by our negligence or breach of contract.

b. If the Unit cannot be installed because of adverse weather or other circumstances beyond our control, our liability shall be limited to return of any money You have paid.

c. We are not liable for your property used or stored in our Unit or for any issues resulting in perished goods as a result of a failure of the Unit.

d. We are not liable for any direct, indirect, incidental, or consequential damages or losses (including loss of goodwill, loss of custom and loss of profit) resulting from the use or inability to use the Unit.

e. We are not liable for breach of contract to anyone other than You.

f. We do not exclude or limit our liability to You for;

  • Death or personal injury arising from Our negligence,

  • Loss or damage caused by fraud by Us,

g. Any liability We have to you under consumer protection legislation that cannot be excluded or limited.

h. We recommend You take out insurance cover against cancellation and loss of goods. We require you to take out cover against theft or damages of the Unit. In many cases You will also be responsible for securing other relevant insurances such as Public Liability and Employers Liability.

10. Changes to these Terms and Conditions

a. If any provision of these terms is deemed invalid, the remaining provisions shall remain in full force and effect.

11. Miscellaneous

We may update these Terms and Conditions from time to time to reflect changes in our practices or for legal and regulatory reasons. The revised Terms and Conditions will be posted on our website with the effective date. Please check back regularly for updates
